Auction Terms and Conditions

1.The auction is open to the public.

2.Buyers must be registered in order to bid at auction.

3.Bids are binding and may not be retracted once accepted by the auctioneer.

4.A 10% buyer’s premium will be added to the high bid to establish the contract price.

5.All deposits shall be paid immediately following the close of the sale in U.S.currency, cashers or personal check.

6.The successful bidder agrees to sign the purchase and sale agreement immediately following the auction.

7.The order of sale and the method shall be at the sole discretion of the auctioneer.

8.The auctioneer reserves the right to add, delete or cancel property for sale or auction.

9.  The auctioneer at his discretion will decide what increments the bidding will be.

10.The auctioneer reserves the right to change or modify by announcement at the beginning of the auction the terms and conditions for the auction. Any such statements or announcements shall take precedence over previously printed materials or oral statements made prior.

11.The auctioneer’s decisions regarding disputes between bidders, bid increments, or sale order are final.

12.Absentee bids will be accepted after buyers agree and sign the proper forms. The forms must be accompanied by an earnest money deposit and delivered to Century 21 All Professional to be held in escrow.

13.The balance of the purchase price shall be due and payable by U.S.currency, cashiers check or by Wire Transfer at closing, 30 days after the auction.

14. Conditions of sale.  Auction property is being sold in AS IS condition unless otherwise announced at the beginning of each auction.

15.  All information given from sources believed to be correct but is not guaranteed.  Buyers must perform their own due diligence and use their own judgment as to the information, records, and condition of the property for auction.

16. Broker Participation wewelcome all REALTOR participation at each auction. We offer 15% of the buyer’s premium paid to Century 21 All Professional to any Floridalicensed Real Estate broker that registered a buyer 24 hours prior to the auction by mail, fax, or web site and successfully closes on the property.

17. Any Real Estate Broker that refers to Century 21 All Professional and its Auction Division Rooks-N-Dunn  a client whose property will be sold at auction will paid a 30% referral fee of the buyer’s commission to the referring broker and salesman once the property has closed.

18.   Agency Disclosure Century 21 All Professional and its auction division   Rooks-N-Dunn  represent the seller in the sale of auction property. Each bidder will be considered to have consented to the issuance of advertisements, press releases, public communications, e-mails by Century 21 All Professional and its auction division Rooks-N-Dunn  for properties offered for and or sold at auction.

19.Radon Gas: Is a naturally occurring radioactive gas that when it has accumulated in a building in sufficient quantities, may present health risk to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county public health units. Buyer may within the inspection period have an appropriately licensed person test the property for radon. If the radon level exceeds acceptable EPA standards, Seller may choose to reduce the radon level to an acceptable EPA level failing which either party may cancel the contract sale  by notifying the seller in writing within 5 days of the test or inspection

20. Lead Based Paint Statement:  If property is a residential dwelling built prior to 1978 such property may present exposure to lead from lead based paint. Buyer may with in 10 days of signing a bi lateral sale and purchase contract conduct a risk assessment or inspection for the presence of lead based paint hazards. If the test results are found to be unfavorable, Buyer may cancel the contract for purchase and sale  by notifying the seller in writing within 5 days of the test or inspection
